These Terms of Service ("Terms") govern your access to and use of Awaken AI, including the Awaken AI mobile application, website, and related services (together, the "Service"). The Service is operated by K-Tech Solutions ("K-Tech Solutions," "we," "us," or "our"). By using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use Awaken AI. These Terms are not a substitute for legal advice for your own situation.
1. What Awaken AI Does
Awaken AI is a gamified productivity and self-improvement application. It helps users turn goals into plans, quests, streaks, reviews, recovery steps, stats, and companion-style progression. The Service may use artificial intelligence to generate plans, summaries, quest suggestions, weekly reviews, recovery guidance, and related coaching-style content.
Awaken AI is designed for general productivity, planning, motivation, and personal organization. It is not a medical, mental health, legal, financial, academic, employment, or professional advisory service.
2. Accounts and Eligibility
- You must be able to form a binding agreement under the laws that apply to you.
- You are responsible for keeping your account and login methods secure.
- You must provide accurate account information and keep it up to date.
- You may not use another person's account or create accounts to abuse free limits, trials, promotions, or platform systems.
3. AI Output and User Responsibility
AI-generated output may be incomplete, inaccurate, repetitive, inappropriate for your circumstances, or unsuitable for a specific goal. You are responsible for reviewing and deciding whether to follow any plan, quest, review, recovery protocol, or other content generated by the Service.
Do not rely on Awaken AI for emergency help, diagnosis, treatment, professional decisions, safety-critical decisions, or any advice that should come from a qualified professional. If your goal involves health, injury, mental health, medication, finances, law, education, employment, or safety, consult an appropriate professional before acting.
4. User Content and Uploaded Files
You may submit goals, notes, profile information, project details, quest activity, and files such as study material or planning context ("User Content"). You keep ownership of your User Content. You grant us a limited license to host, process, transmit, analyze, and display User Content as needed to operate, secure, support, and improve the Service.
- Only upload content that you have the right to use.
- Do not upload highly sensitive information unless it is necessary and you understand the risk.
- Do not upload illegal content, malware, private data about others without permission, or content that violates third-party rights.
5. Subscriptions, Free Trials, and Billing
Awaken AI may offer paid subscription plans, including Pro monthly and Pro annual plans. Prices, trial availability, subscription length, renewal terms, and included features are shown in the app and in the Google Play purchase flow before purchase.
- If you start a free trial, the trial lasts for the period shown at checkout. Unless you cancel before the trial ends, the subscription automatically converts into a paid auto-renewing subscription.
- Subscriptions automatically renew unless cancelled in Google Play before the renewal date.
- You can manage or cancel subscriptions in your Google Play account settings.
- Deleting your Awaken AI account does not automatically cancel a Google Play subscription. You must cancel the subscription through Google Play.
- Refunds and billing disputes for Google Play purchases are handled under Google Play policies and tools.
Pro features may include AI coaching actions, plan generation, plan edits, weekly reviews, recovery features, advanced stats, Strict Mode, premium companions, and future Pro tools. Unless explicitly stated otherwise in the app, AI coaching actions are limited and are not unlimited. At launch, Pro includes up to 10 AI coaching actions per monthly cycle. Free users may receive a smaller monthly allowance. Limits may reset, change, or be adjusted to protect service reliability and prevent abuse.
6. Acceptable Use
You agree not to use the Service to:
- break the law, infringe rights, harass, exploit, or harm others;
- generate instructions for violence, self-harm, abuse, illegal activity, or evading safety systems;
- upload malware or attempt to disrupt the Service, our providers, or other users;
- reverse engineer, scrape, overload, resell, or misuse the Service;
- misrepresent your identity or manipulate trials, purchases, referrals, limits, or platform systems.
7. Account Deletion
You can request deletion of your account and associated app data from inside the app or through our public deletion instructions at getawakenai.com/delete-account. Some limited records may be retained where required for security, fraud prevention, legal compliance, payment records, backups, or dispute handling.
8. Service Changes and Availability
We may update, add, remove, limit, suspend, or discontinue features at any time. We work to keep Awaken AI reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, or available in every location or on every device.
9. Termination
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for the Service or other users, abused platform systems, or used the Service unlawfully. You may stop using the Service at any time and may request account deletion.
10. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. We do not guarantee that using Awaken AI will produce any specific personal, academic, health, financial, career, or productivity result.
11. Limitation of Liability
To the maximum extent permitted by law, K-Tech Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or personal decisions made based on Service content. Our total liability for any claim related to the Service will be limited to the amount you paid for the Service during the three months before the claim, or 50 USD if no payment was made, unless applicable law requires otherwise.
12. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may provide notice in the app, on the website, or by other reasonable means. Continued use of the Service after updated Terms take effect means you accept the updated Terms.
